1) Who we are

BuildWithDani (BWD) is the controller and publisher of the Services.

2) Using our Services

• You must be 13+ (or the age of digital consent in your region).
• Keep your credentials confidential and accurate.
• We may update or discontinue features at any time with reasonable notice where practical.

3) Licenses & product-specific terms

We grant you a limited, revocable, non-transferable license to install and use our software solely for its intended purpose and in accordance with these Terms.

3.1 Flotix — Desktop Browser

• Provided as a desktop application under this license.
• You may not reverse engineer, modify, or redistribute without our written permission.
• Flotix may process device info and optional diagnostics as described in the Privacy Policy.

3.2 Arrivio — Shopify App

• Requires an active Shopify store and permissions you approve during install.
• You authorize Arrivio to process store data (e.g., orders, customers, tickets) to provide helpdesk and returns automation features.
• You remain responsible for your store's compliance with applicable platform rules and laws.

3.3 AutoIQ — Desktop Diagnostics

• Designed to read vehicle OBD-II data through a compatible adapter and visualize diagnostics.
• For informational purposes only; not a substitute for professional advice or certified repair procedures.

4) Acceptable use

You agree not to:

• Breach laws or third-party rights;
• Upload malicious code or attempt to gain unauthorized access;
• Scrape, mine, or bulk-export data except via documented features;
• Circumvent technical restrictions or license gating.

We may suspend or terminate access for violations.

5) Subscriptions, payments & taxes

Paid features (if any) are billed via our payment provider (e.g., Stripe) according to the presented plan and billing interval. Prices may change with prior notice. Unless required by law, fees are non-refundable once a billing period begins. You're responsible for any applicable taxes.

6) Intellectual property

All rights, title, and interest in the Services—including software, content, logos, and trademarks—belong to BWD and our licensors. You retain ownership of your content and grant us the necessary rights to operate the Services.

7) Third-party services

We may integrate third-party services (e.g., Shopify, analytics, crash reporting). Their terms and privacy policies govern your use of those services.

8) Warranty disclaimer

The services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9) Limitation of liability

To the fullest extent permitted by law, BWD and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claims relating to the Services is limited to the amounts paid by you to BWD in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in that case, those limitations apply to the maximum extent permitted.

10) Term & termination

These Terms remain in effect until terminated. You may stop using the Services at any time. We may suspend or terminate access with notice if you materially breach these Terms or to comply with law.

11) Changes to these Terms

We may update these Terms. When we do, we'll update the "Effective" date and provide reasonable notice where required. Continued use means you accept the changes.

12) Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-laws rules. Venue and jurisdiction lie in the courts located in the United States.
